Individuals who are out of status and have spent considerable time in Canada may be eligible to apply for permanent residence on H&C basis. However, an application must meet legal criteria and must clearly demonstrate that applicants may experience unusual, undeserved, or disproportionate hardship if they are to leave Canada. Individuals who have been asked to leave Canada may also apply for permanent residence through H&C applications.
Under UN Conventions, an individual may be considered a Convention refugee if they have a well-founded fear of persecution upon returning to their country of citizenship or country of legal permanent residence. IRCC / CBSA Officers receive refugee claim within Canada at designated offices or at any port-of-entry, they will then decide whether it is eligible for referral to the Immigration and Refugee Board of Canada (IRB), for further decision on immigration and refugee matters. The IRB decides who is a Convention refugee or a person in need of protection. Convention refugees may also be eligible to apply for permanent residence.
